OFFICIAL RULES: Westways® 2024 Road Trip to Las Vegas Sweepstakes
Some aspects of these rules differ from previous contests. Please read them carefully.
NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING.
1. ELIGIBILITY
Entrants (each, an “Entrant”) must be legal residents of California who are 21 years of age or older as of the date of entry, and members* in good standing of the Automobile Club of Southern California, 3333 Fairview Road, Costa Mesa CA 92626-1698 (“Auto Club” or “Sponsor”), prior to April 23, 2024, to enter the Westways® 2024 Road Trip to Las Vegas Sweepstakes (the “Sweepstakes”).
Entry in the Sweepstakes does not constitute entry into any other promotion, contest or sweepstakes. By participating in the Sweepstakes, each Entrant unconditionally accepts and agrees to comply with and abide by these Official Rules (the “Official Rules”) and the decisions of Sponsor, which shall be final and binding in all respects.
*Note: The entrant must possess his or her own 16-digit AAA membership number, meaning that he or she is either a primary, associate, or dependent (subject to the age restriction above) member. Membership numbers of potential winning entries are checked.
Employees of the Auto Club and its affiliated clubs, affiliates, subsidiaries, and related companies, participating promotional vendors (and their affiliates, subsidiaries, and related companies), and service providers and their respective immediate families (as well as household members of each, whether related or not) (together, the “Promotion Entities”), are ineligible. Void outside of California and wherever prohibited by law.
2. SWEEPSTAKES DEADLINE
The Sweepstakes commences at 12:01 p.m. PDT, April 23, 2024, and ends at 11:59 p.m. PDT, July 1, 2024. Sponsor’s computer is the official timekeeping device for the Sweepstakes.
3. ENTRY
To enter, go to AAA.com/vegasroadtrip and follow the presented instructions to enter or mail a postcard with the necessary postage and your name, address, and phone number to Westways® 2024 Road Trip to Las Vegas Sweepstakes , P.O. Box 25001, Santa Ana, CA 92799-5011 (the “Submission”). Each household may only submit one Submission per Promotion Period. Online entries must be received by July 1, 2024 and mail-in entries must be postmarked by July 1, 2024 and received by July 8, 2024. No substitutions of new versions of Submissions will be accepted under any circumstances once the original Submission is submitted for consideration.
4. WINNERS
On or about July 17, 2024, Sponsor will conduct a random drawing from among all eligible entries received during the Promotion Period to select one (1) Grand Prize winner, one (1) Second Prize winner, and one (1) Third Prize winner.
Only the winners will be notified via phone and/or email by July 31, 2024. Winners will be required to sign and return an Affidavit of Eligibility. All Prize Claim Documents, without any alteration, must be received by us within 30 days of the date of delivery of notification to a potential winner, or alternate winners will be selected; provided, that under no circumstances shall Sponsor be required to make more than three attempts to award a prize.
5. PRIZES
Grand Prize (1): A three (3) night stay in a Deluxe King Room or Deluxe Queen Room at Aria Resort and Casino in Las Vegas, Nevada (Sunday - Thursday stay only, based on availability), (b) a $200 food and beverage credit to Aria outlets and (c) two (2) tickets to either Mad Apple at New York-New York Hotel & Casino or Americas Got Talent at Luxor Hotel & Casino. Approximate retail value (“ARV”) $1,200 (the “Grand Prize”). Prize excludes airfare/transportation to/from Las Vegas, NV.
Second Prize (1): The Second Prize winner will receive a Dell Inspiron 14 2-in-1 laptop, ARV $799.99 (the "Second Prize").
Third Prize (1): The Third Prize winner will receive a Garmin Venu® Sq Smartwatch 40MM - Slate Aluminum Bezel with Shadow Gray Case and Silicone Band; ARV $199.99 (the “Third Prize,” and collectively with the Grand Prize and the Second Prize, the “prizes”).
Actual odds of winning each prize depend on the number of eligible entries received during the Promotion Period.
The Grand prize winner’s travel companion must be 21 years of age or older, or if such travel companion is under the age of majority in his or her state of residence (a “minor”), the prize winner must be such minor’s parent or legal guardian, or travel with the written permission of such parent or legal guardian. The prize winner and his or her travel companion must travel together on the same itinerary and must possess all required travel documents, and comply with any applicable hotel check-in requirements, such as presentation of a valid credit card.
Room taxes and other hotel fees that are not included may be payable at the time of check-out by the winner/guest. A deposit or payment in advance, or presentation of a credit card by the prize winner, may be required at the time of check-in at the hotel. Any hotel cancellations or changes to hotel reservations after confirmation must be made with the hotel directly, and the prize winner is solely responsible for any charges and/or fees arising from changes made directly with the hotel.
The prize restrictions/conditions stated herein are not all-inclusive and the prize described above may be subject to additional restrictions/conditions, which may be stated in the “Prize Claim Documents” and/or other travel documents.
All Hotel/Resort prizes: Occupancy limits may apply. Subject to availability and blackouts.
Many travel destinations may still have COVID-19–related restrictions. Before making travel plans, check to see if hotels, attractions, airlines, cruise lines, tour operators, restaurants, and local authorities have issued health and safety- related restrictions or entry requirements. Local tourism boards are good resources for updated information.
Taxes, if any, are the responsibility of the winners. Winners, as applicable, will be issued IRS Form 1099. Airfare and other transportation, baggage fees, taxes, fees, gratuities, and all other expenses not expressly specified herein are the responsibilities of the winners. No prize substitutions will be allowed except by Auto Club, if, in its sole and absolute discretion, it determines that a prize component is not reasonably available, in which case a prize of equal or greater value will be awarded. Prizes, including, but not limited to, hotel nights and airfare, are nontransferable, nonrefundable, not redeemable for cash, and may not be sold. Certain other restrictions may apply. Auto Club acts only as an agent for the various providers listed. CTR# 1016202-80.
ALL PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND SPONSOR HEREBY DISCLAIMS ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR NON-INFRINGEMENT.
Other Prize Terms and Conditions:
Hotel, venues, outlets or other facilities at any MGM Resorts Las Vegas hotel destination may still be subject to COVID-related requirements. Visit the property, restaurant, outlet or venue website for details regarding any such requirements. Guests who have a positive COVID-19 test while at an MGM property or venue are required to follow MGM’s health and safety incident protocols. As noted by government health officials, complete isolation from the COVID-19 virus or any other communicable disease is impossible. No facilities are risk-free, it is possible that you may contract COVID-19 or any other communicable disease during your presence at such facilities, and that you freely choose to enter such facilities with awareness of the associated risks.
In addition to the above, the Grand Prize, including stay at the Aria, is provided on a space available basis and may be utilized Sunday through Thursday only, valid only until June 30, 2025. Blackout dates may apply. Limit two (2) guests for Deluxe King Room or Deluxe Queen Room. Unless otherwise indicated herein, all elements of a prize must be used in the same stay. If applicable, the prize is also subject to terms and conditions set forth in applicable prize certificate. This award is non-transferable, and the Grand Prize winner must be twenty-one (21) years of age or older to redeem. The Grand Prize winner will contact MGM Resorts leisure sales (via the contact information to be provided by Sponsor to the Grand Prize winner) with preferred travel dates at least thirty (30) days in advance to make reservation. Sponsor will not be able to permit any extensions beyond the validity dates previously outlined. A copy of your MGM winner notification letter (the “MGM Winner Letter”) (to be provided by Sponsor to the Grand Prize winner) will be required by MGM Resorts, International office at the time of reservation and the original MGM Winner Letter will be required to be presented upon check-in at Aria. The food and beverage credit is not valid for gratuities, and must be used by July 31, 2025. Food and beverage outlets and outlet hours of operation are subject to availability and/or closures. Unused food and beverage credit will be forfeited.
6. MISCELLANEOUS
This Sweepstakes is subject to all federal, California, and local laws, and is void where prohibited. Winners agree that Auto Club and prize contributors, including their parents, subsidiaries, affiliates (and related companies), officers, directors, and employees, shall not be liable for and are hereby released from, any and all costs, injury, loss or damage of any kind resulting directly or indirectly from the Entrant participating in this Sweepstakes or from the acceptance or use of any prize awarded (including any Entrant’s guests), or from use of their names, photographs, and/or likenesses for advertising and publicity purposes without any compensation and upon request, will provide written consent to such use (“Release”). Any guest accompanying the winners will be required to sign and return a release of liability/publicity within a specified time. Failure to return documents in a timely manner or the return of prize notification as undeliverable will cause Prize(s) to be forfeited. Auto Club reserves the right to verify eligibility qualifications of any winner(s). Sponsor, in its sole discretion, reserves the right to disqualify any person tampering with the entry process, or who is otherwise in violation of the Official Rules.
Sponsor further reserves the right to cancel, terminate, or modify the Sweepstakes if it is not capable of completion as planned, or for any other reason, including, but not limited to, for example, infection by a computer virus, bugs, tampering, unauthorized intervention, or technical failures of any sort. In the event of early termination of the Sweepstakes, winners will be selected from all eligible entries received at the time of termination in accordance with the judging procedures described above. In no event will Sponsor be responsible for any damages or losses arising out of access to and use of the website, or the downloading from and/or printing material downloaded from said site.
Sponsor is not responsible for lost, late, incomplete, illegible, or misdirected entries, nor is it responsible for incorrect or inaccurate information utilized in the Sweepstakes. Receipt of entries cannot be confirmed. In the event of a dispute concerning the identity of a person submitting an online entry, the entry will be deemed submitted by the person in whose name the email account is registered.
All decisions and/or actions by Sponsor shall be exercised in its sole and absolute discretion.
7. GOVERNING LAW; CONSENT TO JURISDICTION; ARBITRATION
The Sweepstakes shall be governed by the laws of the State of California without regard for choice of laws or conflicts of laws principles. Any and all controversies, disputes, claims, or counterclaims or other disputes Entrant may have with, or claims Entrant may have against the Promotion Entities relating to, arising out of or connected in any way with the Sweepstakes, the awarding or redemption of any prize, and/or the determination of the scope or applicability of this agreement to arbitrate (each a “Claim”) will be resolved individually and exclusively by final and binding arbitration administered by the American Arbitration Association (“the AAA”) and conducted before a sole arbitrator pursuant to the Code of Procedure established by the AAA. The arbitrator's decision in any such arbitration will be final and binding upon the parties and may be enforced in any court of competent jurisdiction. The arbitration shall be held in Orange County, California. The parties agree that the arbitration proceedings will be kept confidential and that the existence of the proceeding and any element of it will not be disclosed beyond the arbitration proceedings, except as may lawfully be required in judicial proceedings relating to the arbitration, by applicable disclosure rules and regulations of securities regulatory authorities or other governmental agencies, or as specifically permitted by state law. The Federal Arbitration Act and federal arbitration law apply to this agreement. However, the Arbitrator, and not any federal, state, or local court or agency, shall have the exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of these Official Rules including, but not limited to, a claim that all or any part of these Official Rules is void or voidable.
If Entrant demonstrates that the costs of arbitration will be prohibitive as compared to the costs of litigation, Sponsor will pay as much of the administrative costs and arbitrator’s fees required for the arbitration as the arbitrator deems necessary to prevent the cost of the arbitration from being prohibitive. In the final award, the arbitrator may apportion the costs of arbitration and the compensation of the arbitrator among the parties in such amounts as the arbitrator deems appropriate.
Neither Entrant nor Sponsor may act as a class representative, nor participate as a member of a class of claimants, with respect to any Claim; arbitration can decide only Entrant’s and/or Sponsor’s, or a prize provider’s individual claims and the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated; provided, however, that if this sentence is declared invalid or unenforceable, either in whole or in part, the remaining sentences of Section 7 shall remain in full force and effect. The arbitrator shall not have the power to award special, consequential, incidental, exemplary, punitive, or other similar damages against Sponsor or any prize provider. Entrant and Sponsor also have the right to bring qualifying claims in small claims court. Notwithstanding anything contained herein to the contrary, Sponsor or any prize provider may seek to obtain injunctive relief against an Entrant for the breach or threatened breach of these Official Rules, without posting bond, in addition to any other remedies in law or equity, which may be available to Sponsor or prize provider, in any of the federal or state courts located in Orange County, California. Each Entrant consents to jurisdiction and venue in the federal or state courts located in Orange County, California, for the purposes set forth above and/or to confirm any award obtained by Sponsor or a prize provider in arbitration.
THIS SECTION LIMITS CERTAIN RIGHTS, INCLUDING THE RIGHT TO MAINTAIN A COURT ACTION, THE RIGHT TO A JURY TRIAL, THE RIGHT TO PARTICIPATE IN ANY FORM OF CLASS OR REPRESENTATIVE CLAIM, THE RIGHT TO ENGAGE IN DISCOVERY EXCEPT AS PROVIDED IN AAA RULES, AND THE RIGHT TO CERTAIN REMEDIES AND FORMS OF RELIEF. OTHER RIGHTS THAT ENTRANT OR SPONSOR WOULD HAVE IN COURT ALSO MAY NOT BE AVAILABLE IN ARBITRATION. If any provision of this Section is found to be invalid or unenforceable, then that specific provision shall be of no force and effect and shall be severed, but the remainder of this Section will continue in full force and effect. No waiver of any provision of this Section of these Official Rules will be effective or enforceable unless recorded in a writing signed by the party waiving such a right or requirement. Such a waiver shall not waive or affect any other portion of these Official Rules. This Section of these Official Rules will survive the termination of your relationship with Sponsor.
8. WINNERS LIST
A winners list will be available upon request once the winners are notified and the prizes are delivered.
